Compensation fees for cultivated land expropriation include land compensation fees, resettlement subsidies and compensation fees for attachments and young crops on the ground. The land compensation fee levied on cultivated land is six to ten times of the average annual output value of the three years before the cultivated land is levied. The resettlement subsidy for cultivated land shall be calculated according to the number of agricultural population to be resettled. The number of agricultural population to be resettled is calculated according to the amount of cultivated land to be expropriated divided by the average amount of cultivated land occupied by the expropriated unit before land expropriation. The resettlement subsidy standard for each agricultural population to be resettled is four to six times of the average annual output value of the three years before the cultivated land is expropriated. However, the resettlement subsidy per hectare of cultivated land expropriated shall not exceed 15 times of the average annual output value of the three years before expropriation. The standards of land compensation and resettlement fees for other land expropriation shall be stipulated by the provinces, autonomous regions and municipalities directly under the Central Government with reference to the standards of land compensation and resettlement fees for cultivated land expropriation. Compensation standards for attachments and young crops on the expropriated land shall be stipulated by provinces, autonomous regions and municipalities directly under the Central Government. For the collection of vegetable fields in urban suburbs, the land-use unit shall pay the new vegetable field development and construction fund in accordance with the relevant provisions of the state. If the payment of land compensation fees and resettlement subsidies in accordance with the provisions of the second paragraph of this article fails to maintain the original living standard of the farmers to be resettled, the resettlement subsidies may be increased with the approval of the provinces, autonomous regions and municipalities directly under the Central Government. However, the sum of land compensation fees and resettlement fees shall not exceed 30 times of the average annual output value of the three years before land expropriation. According to the level of social and economic development in the State Council, under special circumstances, the standards of land compensation and resettlement fees for cultivated land can be raised.
